Abstract

"Algeria's constitutional justice system experienced a significant transformation with the creation of the Constitutional Court through the 2020 constitutional amendment, which replaced the former Constitutional Council. The Court is entrusted with overseeing the constitutionality of laws, both through preventive review before enactment and through subsequent review via the constitutional challenge procedure that enables individuals to contest the constitutionality of laws during judicial proceedings. In addition to this, the Constitutional Court adjudicates electoral disputes, rules on the lifting of parliamentary immunity, and resolves conflicts between constitutional institutions. It also ensures that domestic laws and international treaties align with the Constitution. Compared to its predecessor, the Constitutional Court enjoys broader and more dynamic powers, introducing more accessible and participatory legal mechanisms, thereby strengthening the protection of fundamental rights and upholding the supremacy of the Constitution in Algeria's legal framework. "
