Résumé

The non-compete clause in an employment contract aims to protect the employer’s interests while respecting the employee’s rights, both during and after the end of the contract. To be valid, it must meet certain conditions. If it is abusive, it can be nullified. If the employee violates it—particularly by working for a competitor or disclosing trade secrets—they may be held liable and face sanctions. However, if the employer fails to fulfill their obligations (such as paying financial compensation), the clause may become void. In cases of valid violations, the employee may be required to compensate the employer, and civil or criminal proceedings may be initiated depending on the seriousness of the breach.
