Abstract

"Criminal protection of patents constitutes a fundamental legal tool for safeguarding inventors’ rights and deterring infringements on their inventions. Algerian Law No. 03-07 criminalizes acts such as unlawful exploitation, counterfeiting, and unauthorized marketing, while imposing strict criminal penalties. This protection aims to create a safe environment for investment and innovation, while respecting free competition. The law also allows the patent holder to resort to criminal courts in addition to seeking civil compensation. Such protection is part of a legislative trend toward strengthening a knowledge-based economy and providing legal guarantees that encourage research and development. It also reflects the state’s commitment to protecting industrial property rights in accordance with international standards. "
