Abstract
"This dissertation explores the legal implications of genetic modification technologies in the context of medical responsibility. With the rise of gene editing techniques such as CRISPR, new challenges emerge regarding the accountability of medical professionals, researchers, and institutions.
The first part of the study outlines the scientific foundations of genetic engineering and its evolution, from early experiments to modern gene therapies. It examines the major benefits of these technologies, including disease prevention, improved treatments, and potential cures for genetic disorders.
However, the second part shifts focus to the ethical and legal risks associated with gene editing. These include unintended consequences, irreversible harm, and the potential misuse of genetic tools. The study analyzes various legal systems, including Algerian law, and highlights the gaps in existing legislation.
A central issue raised is the definition of liability: Who is responsible when gene therapy causes harm? The doctor, the geneticist, the biotech company, or the patient? The research argues for the adaptation of existing legal frameworks to cover these new realities.
In conclusion, the dissertation calls for urgent legal reforms, bioethical safeguards, and clear regulations to ensure accountability in the use of genetic modification within medical practice.
