Abstract

The theory of nullity in criminal procedures is both important and complex. Its importance lies in its connection to criminal procedures that affect individuals' lives. The complexity of the theory of nullity stems from the dispersion of its rulings and the richness of its jurisprudential interpretations, allowing researchers to find multiple solutions to the same problem. Therefore, in light of jurisprudential and judicial interpretations, this analytical memorandum addresses the following points: the concept of nullity; concepts of omission, error, and inadmissibility; substantive and non-substantive procedures; legal nullity, self-nullity, and relative nullity; cases of nullity; procedures for determining nullity; ways of determining nullity; the parties entitled to claim or waive nullity; the parties that determine nullity; and finally, methods of correcting nullity.
