Abstract

As a result of the technological development of modern means of communication_which have influenced the ways of entering into contracts and executing them_ contacts are being entered into through electronic ways. Therefore, the law has required formality in electronic contracts with taking into account the privacy of electronic writing which appears through the fulfillment of the electronic editor editors of the objective and procedural conditions to confirm its source and the reliability of its conservation. The electronic signature appears in the law 04/15 which concerns the general regulations of electronic signature and authentification. This study has been achieved according to a simple plan composed of two chapters. The first chapter represents the definition of the formal electronic contracts. The second chapter deals with the role of formality in the confirmation of electronic contracts.
