Abstract

This research dealt with a topic that is one of the calamities of this era and its emerging issues, which is commercial insurance. We studied this topic from the legal and legislative sides, through three different stages. In the first stage, we dealt with the legal aspect and analyzed commercial insurance from the perspective of Algerian law, and in the first stage The second we touched on the Sharia aspect, where we analyzed the provisions of Islamic Sharia related to commercial insurance, and mentioned all the differences that existed around it until we reached the aspect that separates them. In the third stage, we dropped the compulsory insurance and studied certain cases in it that are important, such as life insurance. Disability insurance, health insurance, and maternity leave insurance and how they are regulated by national legislation and social security.
