The study adopts a comparative approach to analyze the provisions regulating marital rights and duties, alimony and dowry, the effects of marriage on children, in addition to the spouses' financial system and inheritance rights. The study showed that the two legislations share a common effort to protect the family and ensure its stability, despite their differences in the legislative policy pursued. While the Algerian legislator maintained some provisions derived from the legal reference, the Tunisian legislator tended to expand the scope of equality between spouses and strengthen the principle of family partnership.
